Premier Dalton McGuinty: Do not pass revised ‘Bill 37’ for changes to animal rights protection

After public outcry and strong criticism, MPP Jack MacLaren of the Progressive Conservative Party of Ontario withdrew private members Bill 37 but is now introducing The Prevention of Cruelty of Animals Act, 2012 in its place on Monday, March 19th, at Queen’s Park.  This new bill will hand over inspection rights for farm animals to members of the Ontario Ministry of Agriculture, Food and Rural Affairs (OMAFRA). This will undermine the protection of farm animals. This revised bill has a clear conflict of interest and bias. Passage of the Bill would provide for zero transparency and accountability in a notoriously inhumane industry. Imagine, the very people who slaughter animals for food will be the ones to “ensure” standards are maintained. It is unconscionable to hand over the welfare of farm animals to any group that has vested interests in the agriculture industry. Indeed, there is such an inappropriate bias here that it is insulting.

Also, under Bill 37, farmers will be allowed to call in their own veterinarians to determine whether abuse exists. Veterinarians who are paid by these farmers and make a living through servicing these farmers’ animals will, in many cases, not want to cause trouble and “bite the hands that feed them”, so they will be compelled to look the other way.

Separating farm animals’ rights from those of ‘pets’ also makes the point that farm animals do not deserve the same care and protection, that they are ‘products’, which is ludicrous. All animals suffer and feel pain and should be afforded equal protection.

There are also concerns about whether police officers have sufficient specialized knowledge of animal husbandry to recognize distress, whether they have the skills to deal with exotic, dangerous or aggressive animals and whether the police service has enough resources to take on this extra role.

Summary:

-Separate inspections into (a) farm animal inspections and (b) non-farm animal inspections

-Farm inspections will be carried out by the Ontario Ministry of Agriculture, Food and Rural Affairs (OMAFRA)

-Non-farm animal inspections will be carried out by the Ontario Society for the Prevention of Cruelty to Animals (OSPCA)

-OMAFRA & OSPCA Inspection officers will be the first response to complaints and will be limited to observation, advisement, education, and writing reports on visits made

-Inspectors will no longer have the power of a police officer and will not be able to inspect without the permission of the land owner

-Enforcement will be done by the OPP or local police force ONLY after abuse has been substantiated and reported on by the inspectors. Police force enforcement to stop actual abuse should be few and far between

-Abused animal removal will only be done with the recommendation of a veterinarian and sanctioned by a justice of the peace

-OSPCA will no longer be able to invoice animal owners

-Only the police will be able to lay charges under the Provincial Offences Act or the Criminal Code of Canada

Ontario PC Party Bill Would Gut Animal Cruelty Laws

 

A Progressive Conservative Party of Ontario bill before the legislature would gut animal cruelty laws and remove prohibitions on causing cruelty and distress to animals, says Lawyers for Animal Welfare (LAW), a Toronto based Canadian registered charity.

There are very serious issues in Ontario!!! and something must be done to protect ALL animals in Ontario.  Far too many are being killed in shelters, the negative reports concerning the OSPCA are well known, with far too many unacceptable excuses:  and one can easily find these reports just by Googling.  Remember the OSPCA is funded by the Feds!!!!! and still goes after taxpayer dollars all the time..wanting donations.

Please take a few minutes tonight to post to all  the animal groups you belong to and everyone you know to contact their MPP immediately as well as Tim Hudak to tell them to STOP BILL 37. It doesn’t have to be long or complicated or formal. Below are links to the contact information for MPP as well as Tim Hudaks email.

 Everyone needs to call/write/email their MPP and Tim Hudak quickly – tonight. Bill 37 comes up for 2nd Reading later this week and if we nip it in the bud quickly we may be able to get it recinded so it will die on the floor and not get any further. There are a lot of people who want to see this go through which are mainly the Dairy Farmers Association and the Ontario Landowners Association and all farmers in Ontario. They are the ones who will benefit from this. These are two strong organizations. We must try to stop this now.

  I am sure when you read what is in the Bill you will all agree with me that it needs to be stopped immediately.  Here is the Bill and it will give you an idea of what is to come if we don’t stop them.

Normally Saturdays and Sundays, better known as a weekend, are the times a person can actually sleep in before getting to the tasks around the house..tackling that TO DO LIST…which always seems to get longer each weekend..know the feeling???

Well for this Blogger, rising early..as it happens..6 a.m. this morning…means having the extra time to catch up on Blog posts, spend time with LOKI during his breakfast, visiting with all his buddies that he brings along..this morning the guests were Fiddle, Henri and Charlie..Charlie got extra cuddles this morning.

The Interior Department’s Bureau of Land Management (BLM) is at it again! This time with the three worse-case scenarios included in one roundup proposal:

  • the massive roundup of 1,000 wild horses;
  • the castration of wild stallions and replacement of wild-free roaming mustangs with geldings; and
  • the zeroing-out of an entire Herd Area (HA), permanently removing all wild horses while leaving hundreds of privately-owned cattle behind.

Making matters worse, the plan also includes sex-ratio skewing of the herds to favor stallions over mares, a strategy that is being implemented in the absence of any scientific justification or review.

A man has been arrested over allegations of animal abuse after he was caught on film appearing to beat a terrified dog with a pole as it desperately tried to get inside its owner’s house.

The video, shot from a neighbouring window, shows what seems to be a white Staffordshire bull terrier being kicked, punched in the face and repeatedly hit while a small boy looks on excitedly.

Within hours of the footage being posted on social networking site Facebook, an angry mob is said to have surrounded the man’s house in Grimsby, north-east Lincolnshire.

Police were called to the address last night and onlookers watched as a man, believed to be the dog’s owner, was arrested.

BEIJING – Traffic was running smoothly on a highway just outside Beijing last Friday – until a man noticed an enormous truck carrying stacks of caged dogs.

Mr. An, an animal rights activist and volunteer at Beijing-based China Small Animal Protection Association, saw the cramped, whimpering dogs and decided to do something. His decision ended up saving the lives of 580 canines, who were on their way to the northeastern city of Changchun, where they were to be slaughtered and eventually served for dinner.

LOKI ONE YEAR LATER – 2011

A Tribute to Tiny Innocent Lives

This month of August marks the first anniversary of the needless slaughter of 22 puppies seized during the Hay River Hoarding case, raid conducted May 29, 2010, 109 dogs involved, 3 dogs were humanely put down immediately during the raid due to severe health conditions.

On May 29, 2010,  23 puppies ranging in age from 2 months to 12 months, were seized, removed from the Hobson property and taken to the Hay River Municipally owned town shelter, where they were bathed, fed, watered and sheltered.   These 23 pups were placed in the  care of caring shelter volunteers, these pups were all treated for worms and remained at the municipal shelter for 2 1/2 months. 

While my many offers made to the Mayor of Hay River to assist in the relocation of these puppies were made within weeks of their rescue, my offers were totally ignored by Municipal authorities.  No response to my offers were forthcoming from Hay River’s Mayor.

Mid August I learned that the pups were no longer at the shelter, and following this tip, I was to learn that indeed the pups had been secretly removed from the shelter, the volunteers asked to leave the property.  When they returned all pups had been removed and it was confirmed to me by way of a Town employee, the Mayor’s Assistant, that the pups were indeed dead. 

Due to the amount of pressure placed upon Municipal Authorities by CFAWR, Canadians for Animal Welfare Reform, the Deputy Mayor finally issued a Press Release dated late August 2010, (copy available) stating that the pups had been removed and destroyed…citing that they were a danger to the public.  Subsequent  media reports, the excuse was being given by Municipal authorities that their destruction was due to inadequate facilities to care for these pups.  (newspaper clippings on file) 

Had my offers to assist in the relocation of these pups to properly equipped and fully operational fac lities outside the NWT been taken seriously  these pups would not have met with death.  So just what is the truth????  and just how were these puppies destroyed?  Humanely by injection administered by a licensed vet or did they meet their end by gunshot?

LOKI, whom you have all come to know due to my work with him, is the SOLE survivor, the one rescued Hobson pup that escaped the shelter, prior to the remaining 22 pups being taken and destroyed.  LOKI is now on YouTube, his story appears here and he is drawing international attention.  Comments are coming in, people care!! about this magnificent and gentle spirit whom I will continue to work with, care for and with all out effort hopefully keep safe by having gone public and international about his story.

As of this date, no explanation as to the method used to destroy these 22 pups has been provided by Municipal Authorities.

Subsequent requests made by the Animal Alliance of Canada (two letters sent)  and CFAWR as well as myself for information relating to the animals left and remaining on the Hobson property all of this time remain ignored, the condition and status of these  83 remaining dogs left on the Hobson property at the time of the raid May 29, 2010, remains a mystery.

As of this date, the exact head count of the number of dogs now on the Hobson property remains a mystery.  How many more pups have been born there since May 29, 2010?

As of this date, the identity of the town employee who was supposedly tasked to supervise and monitor the care of the 83 dogs left on the Hobson property (per published media account) remains a mystery.

As of this date, Hay River’s Mayor and Town Council, continues to practice a code of silence .

In early September 2011, after far too many adjournments, Linda Hobson, owner of the 109 dogs, will be facing Federal and Territorial charges of animal cruelty.  Just what sentence, if any will be imposed….remains a mystery.  Just what fate the  animals currently on this property will face once a court decision has been rendered…remains a mystery.

On May 15, 2011, after my three and a half year battle with the Territorial Government, the new NWT Dog Act came into effect.  A Victory for the Dogs of the Northwest Territories and the first step towards the Comprehensive Animal Protection Act that I plan to continue fighting for.

August 2011 marks the First Anniversary of the Hay River slaughter of 22 Innocent lives, rescued pups that were never given the chance at loving forever homes. 

Please remember these tiny lives, these tiny spirits, these tiny hearts whose only crime was to be born in the Northwest Territories, born to a life of confinement..Born to Die!!!

Twenty-two lives lost, twenty-two out thousands across the NWT who have lost their lives due to indifference, due to complacency, due to decades of violent abuse and neglect, due to totally inadequate shelter facilities and  availability of veterinary services across the NWT. 

 Due to an ATTITUDE!!!

 Rest in Peace little ones, your suffering and your sacrifice will never be forgotten.

 Together we can prevent this from ever happening again!!

EFFECTIVE MAY 15 2011 THE NEW NORTHWEST TERRITORIES DOG ACT CAME INTO EFFECT

Confirmation by way of an email received on May 18, 2011 from MACA Minister Robert McLeod’s office states:  “The amendments to the Dog Act are in force effective May 15, 2011.”

While this new Dog Act pertains only to dogs in the NWT it is a Victory, it is historical.  The NWT has never had an Act protecting the dogs up here.  The original Act protected HUMANS from Dogs.

This is the FIRST step towards the Comprehensive Animal Protection Act needed and work towards achieving that goal will continue.  Until a comprehensive Act is in place the NWT will continue to remain in the Bottom Tier as reported by the Animal Legal Defense Fund.  For two years running (2009 and 2010) the NWT was awarded the dubious distinction of being “The Best Place to Abuse Animals”.

Some of you who have followed this Blog over the years are fully aware of the decades of unabated, un-prosecuted cases of horrific animal neglect and cruelty.  Hopefully now the new Dog Act in conjunction with the Canadian Federal Criminal Code will put an end to the suffering and bring those who inflict such horror to justice.

To all of you who have given your support to myself and to the dogs here……THANK YOU!!!!

My work towards a Comprehensive Act will continue, monitoring and reporting of all animal cruelty incidents will continue.

There remains much work yet to be done.  Municipalities across the NWT now need to ensure that the New Dog Act is enforced and if needed amend their own specific By-Laws accordingly; veterinary services across the NWT need to be expanded, educational programs on Animal Welfare and Care need to be implemented, fully equipped animal shelters need to be established, and most importantly fully trained qualified Animal Cruelty Investigators need to be implemented.  All reports of suspected animal cruelty must be investigated and action taken to aid animals in crisis..remember that neglect abused dog on a two foot chain in a neighbors yard may very well reflect the potential family abuse within that home.  The Link Between Animal Cruelty and Human Violence is very real.
